This Privacy Policy" (hereinafter referred to as the “Privacy Policy”) constitutes the terms and conditions governing the use of your personal data/information within the services of PT Prodia StemCell Indonesia, which are owned and managed by PT Prodia StemCell Indonesia (“ProSTEM”). This reflects ProSTEM’s compliance with the applicable laws and regulations of the Republic of Indonesia, particularly, Law No. 27 of 2022 concerning Personal Data Protection, Law No. 11 of 2008 concerning Electronic Information and Transactions, as amended by Law No. 19 of 2016 on Amendments to Law No. 11 of 2008, and further amended by Law No. 1 of 2024 on the Second Amendment to Law No. 11 of 2008 concerning Electronic Information and Transactions, Government Regulation No. 71 of 2019 concerning the Implementation of Electronic Systems and Transactions, Minister of Communication and Informatics Regulation No. 20 of 2016 concerning the Protection of Personal Data in Electronic Systems, and all of their implementing regulations and subsequent amendments from time to time.

ProSTEM highly values your personal data or information as a form of privacy and is committed to maintaining and protecting the confidentiality, integrity, and security of all personal data or information relating to an individual—whether identified and/or identifiable on its own or in combination with other information, directly or indirectly—whether collected electronically through the Website, Application, and/or non-electronically. Such information includes, but is not limited to, your full name, date of birth, phone number, home or billing address, email address, medical information, or any other information considered personal data under the applicable laws and regulations, which you provide to ProSTEM (hereinafter referred to as“Personal Information”).

This Privacy Policy forms an integral and inseparable part of the Terms and Conditions of ProSTEM’s privacy policy and/or any specific policy terms established by ProSTEM. ProSTEM continuously strives to enhance its services and regularly updates them to ensure the protection of your privacy and the security of your personal data as a ProSTEM Customer. This Privacy Policy governs how ProSTEM handles your personal data/information, including the processes of obtaining, collecting, processing, analyzing, storing, displaying, disclosing, transmitting, granting access to, and/or destroying your personal data/information. Such actions constitute ProSTEM’s compliance with the prevailing laws and regulations of the Republic of Indonesia, particularly Law No. 27 of 2022 concerning Personal Data Protection, along with any of its amendments and implementing regulations from time to time (hereinafter referred to as the “Processing” of your personal data) in connection with your use of ProSTEM’s services, which include:

  2. Processing, production and distribution services for stem cells, cells and secretomes for therapy;

(hereinafter referred to as the “Services”)

Furthermore, this Privacy Policy applies to all owners of Personal data (Data Subjects), related to the use of the ProSTEM services mentioned above.

    c. Virtual Tour. You can access a video tour of the ProSTEM lab, which can only be accessed using an official ProSTEM password.
  7. For the avoidance of doubt, you understand and acknowledge that the information displayed on the Information Service may differ from actual conditions.
  8. You understand that in the event that you require emergency medical care, ProSTEM does not recommend that you use this Website.
  9. ProSTEM reserves the right to change, delete, and/or implement new terms and conditions in these Terms and Conditions at any time. Changes to the Terms and Conditions will be effective immediately and will be notified to you upon your first access to the Website after the changes become effective. You agree to indemnify and hold harmless ProSTEM, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries, and affiliates from any claim, loss, liability, suit or expense (including attorneys' fees), made against ProSTEM by any third party due to or arising out of or in connection with your use of the ProSTEM Website or your violation of these Terms of Use.

12. Termination of Service

  1. You are under no obligation to use the ProSTEM Website and may choose to discontinue use at any time.
  2. ProSTEM reserves the right to immediately suspend, restrict or terminate your Use of the Application and/or Services if ProSTEM suspects that you have violated any provision of these Terms of Use or violated applicable laws and regulations.
  3. The administrator and all related parties, including customers, agree to ignore the provisions of Article 1266 of the Civil Code, to the extent required by a court decision or approval to terminate these Terms of Use.

13. Others

  1. ProSTEM reserves the right to investigate and prosecute any violation of these Terms of Use to the fullest extent permitted by law. You hereby acknowledge that ProSTEM has the right to monitor access to and use of the Website to ensure compliance with these Terms and Conditions, or to comply with applicable regulations or orders or requirements of a court, administrative agency, or other governmental body.
  2. These Terms and Conditions are effective from the time you give your consent to use this Website and will continue to be in effect and binding on you until ProSTEM terminates these Terms and Conditions.
  3. These Terms and Conditions are governed and interpreted based on the laws of the Republic of Indonesia and in connection with the termination by ProSTEM as referred to in paragraph 2 above, you and ProSTEM agree to set aside the provisions of Article 1266 of the Civil Code which requires a court decision in terminating an agreement.
  4. Any disputes arising between you and ProSTEM regarding the implementation of these Terms and Conditions will be resolved through deliberation to reach a mutual agreement. If such dispute cannot be resolved through deliberation, you and ProSTEM agree to have the dispute resolved in the Central Jakarta District Court.

By using the ProSTEM Contact service, you warrant that the personal data you provide is accurate and truthful. If the personal data you provide is proven to be inaccurate, ProSTEM is not responsible for any consequences that may arise from the provision and use of such inaccurate personal data.

1. Information you provide to the ProSTEM Contact Center

Your data through the ProSTEM Contact Center is obtained when you contact ProSTEM via telephone, email, SMS, chat applications (WhatsApp, Telegram, Messenger, Website, etc.), or social media (Twitter, Facebook, Instagram, or others). Through these services, the ProSTEM Contact Center collects your personal information/data in the form of customer ID, name, address, telephone number, email, and social media accounts.
